Dispute Resolution

Diamond Gold Company is committed to fair and prompt resolution of any disagreements. This section describes how claims are handled and disputes resolved.

1. Pre-trial (Claim) Procedure

In the event of a complaint, disagreement or disputed situation, the parties first attempt to resolve the matter through direct negotiation. The Buyer sends a written claim to info@diamondgoldcompany.com stating: the order number, a description of the issue, the requested remedy and a preferred resolution method. We undertake to review all claims within 10 business days of receipt and provide a written response. Most disputes are successfully resolved at the negotiation stage, benefiting both parties and avoiding legal costs.

2. Governing Law and Language

The relationship between Diamond Gold Company and the Buyer is governed by the law of the Kyrgyz Republic, including the Civil Code and the Consumer Protection Law of the Kyrgyz Republic. The official language of documentation is Russian. In the event of discrepancy between versions in different languages, the Russian version prevails. Buyers from the UAE, Russia, Kazakhstan and other countries enjoy the same rights under the applicable laws of the Kyrgyz Republic and may also invoke the norms of private international law of their own country.

3. Judicial Resolution

If the parties cannot resolve the dispute pre-trial within 30 days of the claim being submitted, the matter is referred to a competent court. The default jurisdiction is the court at the Seller's location - Bishkek, Kyrgyz Republic. Buyers from other countries are also entitled to bring a claim in a court or arbitration at their place of residence in accordance with private international law and applicable bilateral treaties. We are open to mediation and alternative dispute resolution methods, as we value every customer and seek fair, mutually beneficial outcomes.
